Congressman Lamar Smith engages in massive and blatant violations of the TCPA using ccAdvertising to initiate automated political polling calls (robo-calls) to 210,000 cell numbers. ccAdvertising has petitioned the FCC to preempt state laws. They are thumbing their nose at the very law that they have based their petition on! The Austin American-Statesman article erroneously claims the calls are legal but the TCPA has only 2 exemptions for automated calls to cell numbers: 1. prior express consent or 2. emergency pupose. Paying for the call or a poll call or a political call is irrelevant. It is the initiation of an automated call to a cell number without prior express consent of the cell number subscriber that makes the call illegal. If you have received one of the calls from ccAdvertising on behalf of Representative Lamar Smith or any other Congressman or Senator on your cell phone then you are entitled to $500.00 in statutory damages for the call.
