Telemarketing Violations
of the TCPA
It is extremely important that the FCC be notified of any live or
prerecorded telephone solicitations that have been initiated by or on
behalf of any of these entities in violation of the TCPA after they
have been cited. The FCC can then proceed against these entities with a
NAL (Notice of Apparent Liability) and a Forfeiture Order of up to
$11,000.00 per violation. In the complaint to the FCC write across the
top of the letter "Re: TCPA Violation After FCC Citation". Mail the

- December 18, 2001; the complaint is based
on one unlawful prerecorded telephone solicitation to a residence. The
unlawful call contains the verbal "yes" to continue which fails as a
defense under the prior express consent requirement of the TCPA. The
prerecorded telephone solicitation does not provide the name of the
individual caller or a telephone number or address
of the entity represented which are additional violations of the TCPA.

currently celebrating our ten year anniversary here in the Friendswood
area. We would like to take this opportunity to invite you and a friend

Chevrolet of Arlington, Texas
- March 5, 2002; the complaint is based on
two unlawful prerecorded telephone solicitations to
a residence. The FCC included the third party telemarketer that
initiated the prerecorded telephone solicitations, a James Polnac
of American Dial of Texas Inc. a/k/a American Marketing Associates. The
prerecorded telephone solicitation did not provide the name of
the individual caller or the name and telephone number of the entity
initiating the prerecorded telephone solicitation all additional
violations
of the TCPA.
- March 19, 2002; the complaint is based on
four unlawful prerecorded telephone solicitations to a residence. The
complainant repeatedly notified the company to stop the calls. The
company claims that the ownership had changed which is not a defense to
unlawful telemarketing activity. In addition to the violation of
failing to honor a do-not-call demand, the prerecorded telephone
solicitations do not provide the name of the individual caller an
additional violation of the TCPA. The prerecorded telephone
solicitation stated "Hello from the new ownership of White Rock
Athletic Club" and offered a "free" membership. The
prerecorded telephone solicitations are an advertisement under the TCPA
definition for a service and claiming an ownership change does not
void a do-not-call demand.
- April 2, 2002; the complaint is based on
one unlawful prerecorded telephone solicitation to a residence. The
prerecorded telephone solicitation does not provide the name of the
individual caller an additional violation of the
TCPA. The prerecorded telephone
solicitation
advertised mortgage loans.

"Hi, this is John Black, senior vice president of
Brentwood Capital your local mortgage company. The reason for my call
and according to your property survey is
that the federal government has recently lowered interest rates
to what is considered an all time low that we recently reviewed, you
may qualify to refinance your home and take advantage of these low
rates.
I will be in my office until 8 PM tonight, call me. Again, it is John
Black at Brentwood Capital. Our office is 615-661-9039. I look forward
to nearing from you."
- April 16, 2002; the complaint is based on
one unlawful prerecorded telephone solicitation to a residence. The
prerecorded telephone solicitation was received by a telephone
answering device. The company claims that the prerecorded telephone
solicitation is a "tip" and not a solicitation which of course it is.
The prerecorded telephone solicitation does not provide the
name of the individual caller which is an additional violations of the
TCPA.
- April 30, 2002; the complaint is based on
two unlawful prerecorded telephone solicitations to a residence. The
company claims that the prerecorded telephone solicitations are a
"free" service and therefore exempt from the TCPA. The prerecorded
telephone solicitations are an advertisement under the TCPA definition
for a service. The prerecorded telephone solicitations do not provide
the name of the individual caller or the name of the entity represented
which are additional violations of the TCPA. Additionally, the complainant
included information in the complaint that the Public Utility
Commission of Texas had
issued a "permit" to the entity initiating the unlawful prerecorded
telephone solicitations. A state agency cannot permit violations of a
federal consumer protection law and consequently, after knowing that a
state permit was involved, the FCC issued its citation.

to a residence. The unlawful call contains the "button press" to
continue which fails as a defense under the prior express consent
requirement of the TCPA. The unlawful call also contains the "negative
option" off removing the telephone number from the calling list.
The company claims that the prerecorded telephone solicitations are
a "free" service and therefore exempt from the TCPA. The prerecorded
telephone solicitations are an advertisement under the TCPA definition
for a service. The prerecorded telephone solicitation does not provide
the name of the individual caller or a telephone number or address
of the entity represented which are additional violations of the TCPA.

complaint is based on an unlawful prerecorded telephone solicitation
to a residential listed with subscriber. The unlawful prerecorded
telephone solicitation did not provide the name or telephone number of
the entity represented - additional violations of the TCPA.
The complainant left their phone number and was able to identify the
perpetrator of the call from the call back.

Mortgage of Houston, Texas (corporate headquarters in California)
- June 18, 2002; the complaint is based on an
unlawful prerecorded telephone solicitation to
complainants residence. The citation is issued against the local
office and the corporation in California. The
prerecorded telephone solicitation does not provide the name of the
individual
caller, the name of the business represented and a telephone number
or address of the business represented all additional and separate
violations of the TCPA.

- June 25, 2002; the complaint is based on an
unlawful prerecorded telephone solicitation to the
complainants residential listed with and failure to include the
proper identification within the message. The prerecorded telephone solicitation advertised web site
development
services and web site hosting.
- Argo Futures
Group Inc. of Ohio (several locations in Ohio)
- July 9, 2002; the complaint is based on one
or more unlawful prerecorded telephone solicitations to residential
listed with subscribers and failure to include the proper
identification within the message. The unlawful call did not provide
the name of individual caller, the name of entity
represented, the telephone number or address of the entity represented,
the name of the entity initiating the prerecorded message and the
telephone number or address of the entity initiating the prerecorded
message
all additional and separate violations of the TCPA. The prerecorded telephone solicitation advertised Heating Oil
Futures.

identification within the message. The unlawful call did
not provide the telephone number or address of the entity represented
an additional violation of the TCPA. The prerecorded telephone
solicitation contains the "button press" to
continue which fails as a defense under the prior express consent
requirement of the TCPA.

of Texas (several locations - mostly Houston Texas)
- July 18, 2002; the complaint is based on
multiple prerecorded messages ("sorry - wrong number")
and multiple live solicitations. The prerecorded messages do not
provide the name of the individual caller, the
name of the business represented and a telephone number or address of
the business represented all additional and separate violations
of the TCPA. Additional, the citation also includes the failure to
honor a do-not-call demand. The telephone
solicitations were selling coupon booklets supposedly on behalf of
educational institutions.

- July 23, 2002; the complaint is based on an
unlawful prerecorded telephone solicitation to the complainants
residential listed with and failure to include the required
identification (name of individual calling, name of entity represented

the message. The call was initiated by the agent of the corporation.

- July 30, 2002; the complaint is based on an

represented) within the message. The prerecorded telephone solicitation
claims to be a survey and offers a "free no obligation" quote. Additionally, one of the complainants
included information in the complaint that the Public Utility

- February 25, 2003;
the complaint
is based on one or more unlawful prerecorded telephone solicitations to
residential listed with subscribers and failure to include the
required identification (name of individual calling, name of entity

represented) within the message. The prerecorded telephone solicitation
was left on an answering machine.

- March 11, 2003; the complaint is based on an unlawful prerecorded telephone

unlawful prerecorded telephone
solicitation was recorded on the complainants answering
machine. Additionally, the initiator of the
unlawful prerecorded telephone solicitation
claims to be a non-profit but charges up front fees
for and profits from the service.

DNC lists and the Federal DNC list. The prerecorded calls violate all
of the identification requirements of the TCPA:

"During the week of January 4,
2004, an individual who identified himself as Randy Sage called the
Division, on behalf of Dynasty, to discuss the citation. On
January 8, 2004, a Division staff member returned Mr. Sage's
call. Mr. Sage claimed that ``as a government-regulated
business,'' Dynasty is exempt from federal
do-not-call rules. The staff person informed Mr. Sage that
neither the TCPA nor the Commission's rules contain such an exemption,
and repeated the citation's warning that Dynasty's continuing telephone
solicitations to consumers who had placed their residential telephone
numbers on the National Do-Not-Call Registry could result in
substantial monetary penalties.
