Will of Mary Margaret Harris

To my two sisters, Eliza J. Kuykendall and Isabell H. Baird, who now reside in Yamhill County, Oregon.

Inasmuch as I desire to avoid any necessity of a Court proceeding for the purpose of distributing what personal property and money I may have left at the time of my death, and having full and complete confidence in your integrity and honesty, and feeling sure that you will retain and distribute such property as I may have, as I have hereinafter suggested and directed, I hereby, in consideration of the love and affection I hold for you and each of you, give and grant and deliver over unto you all of the money which I may have at the time of my death, notes, mortgages, personal apparel, household goods, furnishings, jewelry, plate and each and every other article and thing of which I may be possessed or which may in any manner belong to me, and werever found, you to distribute and pay said money and to give said articles in sums and to the persons hereinafter named; provided, however, that in case I do, during my lifetime fulfill either or any of the matters hereinafter enumerated - which will be cancelled thereon by me, the date of which will be found with such cancellation or crossing out, - then, of course, you are not to consider such item or such person in your distribution or dealing with the property hereby turned over to you. Provided, further, also that I desire you to first pay out of such money and property all my just debts and funeral expenses, and such other claims, if any, as you feel should be paid, you to be the sole judge of what is right, and just, should any question arise. And to further provide that at my grave and also at the grave of my late husband, in case I do not provide the same for his grave, a suitable tombstone, as hereinafter directed by me. I further state that in addition to what I may hereafter direct that you shall retain, that in case there is any money or property of any kind belonging to me not herein otherwise disposed of, that you shall divide the same betweeen you according to your own judgment, share and share alike. Should either of you depart this life prior to my decease, then I desire and hereby make the survivor of you the trustee hereunder, the same as though such survivor had been named solely in this document giving and granting unto her the same privileges, rights and powers as are herein granted to you both.

I would further suggest that I have prepared and executed deeds to you as trustee and otherwise for all of the real property which I have, which deeds you will find with this document. You will kindly take charge of them and record them just the same as though they had been delivered to you prior to my decease. I do this fully believing that all of my relatives will have absolute confidence in my desire to treat them in a conscientious and just manner, and in making this distribution of my property, and that in which my late husband had an interest, I have a deep sense of gratitude for his memory and have tried to remember his good sisters, the same as I feel he would do were he alive, and I trust that you will be able to adjust all of the little matters connected with my property interest, real and personal, in such a way that will be satisfactory to all concerned, and that you will feel that you have carried out my wishes to the full intent and spirit of them. The manner in which I desire my money and property distributed I have made on a separate sheet of paper, which you will find attached hereto and signed by me.

Dated, Portland, Oregon, April 7, 1909.
