The following booking terms and
conditions are essential to ensure the quality of your stay and
that of future guests.
Confirmed
Booking
The acceptance of the terms and
conditions set out below shall be binding on all the persons
intending to occupy the property whether or not such persons
have signed the booking form. The owner will confirm each
booking as soon as possible after receipt of the signed booking
form and deposit is received. Once the owner has issued the
booking confirmation the signatory is responsible for the total
price of the rental property as agreed. The remaining balance
must be paid 10 weeks prior to arrival. If the full balance is
not paid 10 weeks before arrival, we reserve the right to revoke
your reservation.
Guests should contact us to check
availability and price. Provisional bookings will only be held
for 5 days. A booking will be considered firm only when the
reservation deposit has been received and confirmed by the
owner. A deposit of USD $300 is required at the time of booking.
The remaining balance of the agreed rental cost must be paid 10
weeks prior to your rental period. If payment is not received,
your reservation will be revoked and your deposit will be
forfeited. Bookings made less than 10 weeks are payable in full
at the time of booking. Only persons named on the booking form
are entitled to use the property. No pets are allowed in the
accommodation. Under Florida Law this property is considered a
public space and therefore no smoking is allowed inside the
villa.
Check In
Check in to the villa is after
4:00 pm on the date of arrival. At the sole discretion of the
property management, any guests arriving to collect keys
before that time may be refused.
Check Out
Check out is on the date of
departure as shown on the Booking Confirmation or Registration
Form, at 10:00 am. All keys must be returned on the date of
departure. In the event that the guest has not departed the
property on the date of departure, at the due time, then the
guest will be charged a additional day’s rental.
Rental Rates
The accommodation rates quoted
are PER DAY or PER WEEK (7 days, not per person), and include
electricity, air conditioning, heating, local telephone calls,
cable TV (excluding Pay-for-View), the use of bed linen, towels,
and other amenities provided in the villa.
Security
Deposit
A $300 deposit is required at the
time of booking. Upon confirmation, the booking deposit becomes
the damage security deposit. The premises will be inspected both
before and at the end of each rental. The party must treat the
property, it's furniture, fittings, utensils and other
facilities with respect. Any loss or damage must be reported
immediately to the management. The party leader is responsible
to pay for any loss, damage or breakage. The owner reserves the
right to withhold any monies from the security deposit to pay
for any loss or damage caused to the property or its contents by
any member of the party. Once it is determined that the property
is in satisfactory condition, the security deposit is released
within 28 days after departure.
Cancellations
Cancellations must be confirmed
with us. In the event of a cancellation, either from you or from
us due to non payment of the balance due within the time allowed
before arrival, cancellation charges will be made as follows;
Prior to 10 weeks before arrival
date = loss of booking deposit
10-8 weeks before arrival date =
50% Deducted
8-6 weeks before arrival date =
75% Deducted
6 weeks or less before arrival
date = 100% Deducted
To cover any possible
cancellation we would strongly recommend that you take out
adequate vacation insurance.
Numbers in Party
Suitability
The numbers of persons occupying
a property must not exceed the maximum number listed in the
booking confirmation including small children. This is Florida
state law and must be adhered to. The accommodations cannot be
shared or sub-let and only the persons shown on the booking form
are permitted to stay in the property. Persons under 21 years of
age must be accompanied by parents or responsible adults. The
owner and property management reserve the right to refuse any
booking, which, in his or her opinion, is unsuitable for the
property.
No Smoking Policy
In accordance with Florida rental
regulations and for the convenience and safety of all guests,
smoking is not permitted inside the villa, garage, or in any
indoor area whatsoever. Smoking is permitted outside on the
patio area Please use the ashtrays provided. Sensitive
smoke detectors are fitted throughout the villa. Any tampering
with smoke detectors will result in a deduction from your
security deposit and possibly lead to legal action against you.
Swimming Pool
Pools are a great source of
enjoyment but can also be dangerous. All children must be
supervised at all times whether actually in the pool or playing
on the surrounding pool deck. Caution must also be taken by all
persons when walking around wet areas. The owner and property
management do not accept responsibility in the event of injury
or death howsoever caused as a result of the use of the pool
area. Please refrain from taking glass or crockery items to the
patio/pool area. Suitable unbreakable items are provided for
this purpose. The pool depth ranges from 3 feet to 5 feet and
the Jacuzzi is approx. 3 feet 6 inches deep. The pool is
regularly inspected, cleaned and maintained but may be affected
by dust, dirt or insects, particularly during or after bad
weather. Very occasionally, pool heating or lighting, etc..
breaks down - in the unlikely event that the pool heating breaks
down during your stay (if you have pre-ordered this), the owner
or property management will either provide the owed day(s) pool
heating at a later time or refund the unused portion of pool
heating costs. Pool heating is recommended but not compulsory
for stays between October & May. Pool heating can ordered for
any month, if so desired, and should be requested at the time of
booking. Note that the Jacuzzi cannot be heated separately from
the pool as it has a waterfall feature which runs water into the
pool - if you wish to have the Jacuzzi heated, you will need to
order pool heating. Note that there is no guarantee of a
specific pool temperature. Sometimes, especially during winter
months, pool heating may appear to make little difference to the
temperature of the water due to the low outside temperature. The
cooler months are generally between November and March. If pool
heating has been ordered but the weather is warm, you will still
be responsible for the charges as the heating will have been
turned on in advance of your arrival and no refunds will be
given in these circumstances. The pool is cleaned and chemically
balanced every week for your safety and comfort; however on rare
occasions it may be necessary to apply extra chemical to the
pool to maintain safe and correct chemical levels. Should this
occur during your stay it will be necessary for you to be out of
the pool for a period of 12-24 hours for safety reasons. Please
note that neither property management nor the owner accepts
liability for compensation for the loss of pool heating or
lighting facilities other than as noted above.
Liability
The owner and the management of
the property accept no responsibility for death, personal
injury, accidents, loss or damage to persons or personal
belongings however caused. The use of all accommodations and
amenities including the pool is entirely at the user’s own risk.
Children must be supervised by responsible adults at all times
when using the pool. Guests are specifically advised not to
allow unsupervised children into the pool area. Glass or
crockery is not permitted within the pool area. The owner or
property management cannot accept liability for acts of
omissions of or changes of third parties, such as Airlines, Car
Hire companies etc. We can neither accept responsibility or
liability for any accident, injury or illness sustained during
your rental period, regardless of how it may occur. The owner
and property management cannot accept responsibility for the
sudden failure of villa equipment but will take immediate
reasonable action to rectify any such failure upon notification
by the guests. If the pool heater does not reach optimum
temperature due to adverse cold weather conditions the owner or
property Management are not liable.
Climate
Guests should be made aware that,
as Florida is a tropical climate it is the home of many insects
etc. All homes are treated on a regular basis to repel such
unwanted pests, but inevitably they occasionally will find their
way inside the property from time to time. They are best
eradicated by spraying with an appropriate product.
Complaints or
Dissatisfaction
The owner does not accept
responsibility for the breakdown of the supply of water, or
electricity, or failure of mechanical equipment such as
air-conditioning, washing machines, dishwasher or swimming pool
systems, though we will try to resolve them to the best of our
effort. In the unlikely event of a need to make a complaint
during your stay please contact our local property management
immediately who will rectify the situation to your satisfaction.
Any complaints must be notified to property management within 24
hours of the occurrence. Should a problem remain unresolved
please make a complaint in writing to the owner within 14 days
of the completion of the rental period. We will not accept
liability for any dissatisfaction or other complaints not
reported to our local agent during your stay.
Valuables
Any valuables left at the
property is at the guests' own risk. Neither the property
management nor the owner nor the staffs are responsible for
their loss or damage.
Insurance
IT IS STRONGLY RECOMMENDED THAT
YOU AND ALL MEMBERS OF YOUR PARTY TAKE OUT HOLIDAY TRAVEL/
MEDICAL INSURANCE TO COVER CANCELLATION FEES AND ANY OTHER
LOSSES THAT MAY OCCUR. IT IS YOU RESPONSIBILITY TO ENSURE THIS
IS SUFFICIENT. THIS IS RECOMMENDED FOR ALL NATIONALITIES
INCLUDING PEOPLE RESIDING IN THE US.
Force Majeure
We cannot be held responsible nor
accept any liability where we are prevented from fulfilling our
contractual obligations by 'force majeure'. Should the property
be destroyed by fire or other casualty so as to become unfit for
human habitation prior to occupancy by a guest, this lease shall
become null and void and all payments made hereunder shall be
refunded to the guest, who agrees to hold the owner and property
management harmless. Should the property be rendered
uninhabitable by an Act of God or Nature (including but not
limited to hurricanes, storms, floods, environmental disaster,
loss of utilities), other events outside our control, during
tenancy, reimbursement on a per diem basis will be negotiated
between the guest and the owner. Your travel insurance may cover
you in some of these events.
Owner Access
The owner or the property
management company may enter your villa to perform any repairs
as necessary, but only by advance appointment and approval of
our guests.
Governing Law
This agreement shall be construed
in accordance with and governed by the law of the United States
of America.
