And inasmuch as ____________________________________________________________________, hereafter called the "Buyer", (address)______________________________________________________________, (telephone number) _______________________, wishes to purchase the described Animal for the sum of $_____________ (full payment made herein; or $_________________ down and $_____________ per month, with the first payment due on or before ________________, and the remaining payments due on or before the ______ of each succeeding month), under the following warranties and conditions, no other warranties or conditions are either expressed or implied.

1. The Breeders guarantee that the described Animal is a purebred Rottweiler, registrable with the American Kennel Club, hereafter called the "A.K.C.", and that a registration application will be sent to the A.K.C. within 10 working days of the execution of this contract. That the described registration shall be as an A.K.C. Limited Registration. It is understood by the Buyer than an A.K.C. Limited Registration will prevent the registration of any offspring produced by the described Animal. That the Buyer shall have sole custody of the described Animal. That the Breeders A.K.C. Registered Kennel Name Prefix (Medeahs) shall be used as the first word in the name given the described Animal on the A.K.C. registration application.  That the described animals name shall not be changed from the name given it in this contract without prior written consent of the Breeders.

2. The Breeders guarantee that the described Animal is born of the parents described above. That the parents described above are free of Canine Hip Dysplasia as certified by the Orthopedic Foundation For Animals, hereafter called the "O.F.A.", and that the O.F.A. certification numbers are listed with the parents names. That the described Animal is in good health at the time of delivery. The Buyer must take the described Animal to a qualified veterinarian within 48 hours of delivery and shall forward a signed statement from the veterinarian stating that the described Animal is in good health. Buyer shall assume full responsibility for the health of the described Animal following said 48 hour period. Buyer further agrees to secure such shots and/or boosters for the described Animal, as outlined by the Breeders.

3. It is understood and agreed that the described Animal shall never be used for breeding purposes by the Buyer or any other persons.

4. The Buyer hereby undertakes to act as insurer in respect to Section 3 of this contract, and to pay to the Breeders the sum of no less than $_________________ as liquidated damages each and every time the described Animal is used for breeding purposes. Should the liquidated damages not be paid voluntarily to the Breeders, the Buyer agrees to be liable for all attorney and Court costs, and all reasonable costs incurred by the Breeders in collecting these damages.

5. The Breeders guarantee that if the described Animal should develop any clinically crippling or disabling congenital or genetic origin physical ailment within one year from the described Animal's date of birth, the Breeders will refund to the Buyer 100% of the original purchase price of the described Animal. Said refund will be made only after return of the Animal to the Breeders for evaluation and verification of the ailment, and for disposition of the Animal. This section of the contract shall cover only ailments that are congenital or genetic in origin, and does not cover ailments that may have been contracted by the Animal from other animals or from the Animals environment. Additionally, the Buyer must have provided the described Animal with reasonable and proper Veterinary Medical care, and the ailment must not be the result of accidental injury and must not be the result of mistreatment of the Animal, or of improper diet or lack of proper exercise for the Animal.

6. The Buyer agrees to have full and sole responsibility for third party liability in the event the described Animal should injure anyone or cause any property damage.

7. The Buyer agrees that should it become necessary to dispose of the described Animal by sale or any other means of transfer of ownership, the Breeders shall be given the First Right of Refusal to purchase back the Animal at a price no more than the Buyer has paid the Breeders for the Animal.

8. The Buyer further agrees to take proper safeguards for the care and safety of the described Animal, including - but not limited to - a fenced yard, proper shelter, adequate feeding, exercise, and OBEDIENCE TRAINING.

9. This contract is made between the Buyer and the Breeders to assure the well-being and protection of the described Animal. No part of this contract is transferable.

10. If the legal residence of the Buyer is not in the State of California, this contract must be signed and notarized by the Buyer in his/her state of legal residence.

11. All legal questions or disputes regarding this contract will be governed by the Laws of the State of California.
